I've been asked twice in as many months if it's legal for me to allow my customers use of SQL Server Express 2005 as it's installed by default on plesk for windows.

I need documentation and a clarification that explains where I have the right to do this. I know it's not against the EULA but i need to document that.

Can someone help?

I know MS licensing quite well and in fact give advise to a number of users here, when you install SQL Express 2005 you agree to this:
4. SCOPE OF LICENSE. The software is licensed, not sold. This agreement only gives you some rights to use the software. Microsoft reserves all other rights. Unless applicable law gives you more rights despite this limitation, you may use the software only as expressly permitted in this agreement. In doing so, you must comply with any technical limitations in the software that only allow you to use it in certain ways. • You may not•
• disclose the results of any benchmark tests of the software to any third party without Microsoft’s prior written approval;
• work around any technical limitations in the software;
• reverse engineer, decompile or disassemble the software, except and only to the extent that applicable law expressly permits, despite this limitation;
• make more copies of the software than specified in this agreement or allowed by applicable law, despite this limitation;
• publish the software for others to copy; or
• rent, lease or lend the software.
 
Anyone? I really need clarification and no response from anyone at swsoft isn't looking very good.
 
This is a stupid question because first of all Plesk does not come with SQL Express but instead it comes with MSDE. Secondly you should ask licensing questions about Microsoft products to Microsoft.
 
That's an extremely stupid reply since it's absolutely not true. SQL Server Express REPLACED MSDE
 
I'm sorry I offended you but still I insist you approach Microsoft for licensing issues. It's not a Plesk issue. Plesk is hosting management software.

The reason I'm here asking is because SWSoft installed the software on the server, I'm just trying to find documentation from them about the licensing. What I know to be correct is that there is NO problem hosting SQL databases for customers. But There are people accusing my company of illegally providing hosting with SQL because they say SQL Express is not legal to rent as a provider.

I don't believe for a second plesk would install software that isn't rentable as a service, it just doesn't make sense. I've been extremely happy with Plesk 8.0.1 and I'm looking forward to 8.1. Been using them since 5.

I wasn't questioning it. Moreso just looking for concrete clarification by plesk as to give me some credible response to the accusation.
